MSEC provides a variety of employment law services to help member
companies cope with increasingly complex state and federal laws
and regulations that affect the workplace. MSEC can help you establish policies, implement procedures,

Unlike many associations,
our attorneys provide much more than information. They
assist members in three distinct phases that precede litigation:
Training. We will train your management
employees on labor relations and employment law issues. Not only
will your management team be better prepared to meet legal requirements;
they will recognize potential problems and know when to seek professional
advice.
Consulting. We are available to
consult with you before a claim is made. Believing that "an
ounce of prevention is worth a pound of cure," our attorneys will
guide you through every step of potentially difficult personnel
situations.
Administrative Representation.
We represent you where the action takes place. If a claim comes
before a state or federal administrative agency, we can represent
you at the investigatory stage, prepare and present a position statement,
handle an administrative trial, or work through a favorable settlement.
Affirmative Action Plans
If you are a federal government contractor/subcontractor, you may be required to maintain
a written affirmative action plan. With MSEC, this no longer has
to be an annual nightmare. Our Customized Affirmative Action Plan
organizes your workforce data and integrates it with appropriate
labor force statistics. The result is a clear, professional set
of reports that comply with affirmative action regulations. We will
also help you design the other portions of your plan and present
it to OFCCP. Expanded services include self audits, compensation
analysis, and design of your AAP program. In addition, we will provide
assistance in defending complaints and during audits.
Civil Rights Complaints
We have represented employers in thousands of charges alleging discrimination.
In the vast majority of cases, litigation and costly settlements
are avoided. We will help you determine alternatives, answer EEOC
or state agency charges, prepare defenses and negotiate settlements.
Our Investigation Services will assist you in the investigation
of alleged misconduct before a complaint is filed.
Drug and Alcohol Issues
In addition to answering day-to-day questions, our attorneys review
drug and alcohol policies and help develop plans that comply with
government requirements. We also provide supervisory training in
this area and drug testing services.
Family and Medical Leave Act
Our staff guides employers through the regulations and requirements
of the Act, assists with the design and implementation of FMLA policies,
and represents members during Department of Labor investigations.
OSHA/Safety
Our staff provides administrative and technical support for compliance
with health and safety issues. We assist in handling inspections,
assessing OSHA citations, negotiating favorable resolutions, and
representing members in hearings before and Administrative Law Judge
or appeals to the Review Commission.
Unemployment Compensation
MSEC regularly represents its members before the Colorado Department
of Labor and Employment. Our services include consulting to minimize
unemployment insurance liability, drafting answers to employee claims,
representing the employer in appeal hearings before referees and
handling appeals to the State Industrial Claims Appeal Panel.
Wage and Hour Problems
Many members use MSEC to sort out sticky wage-hour issues. We can
answer questions about minimum wage, hours of work, pay periods,
independent contractors, equal pay and record keeping. We will assist
you during agency audits, help you develop alternatives in handling
complaints, and negotiate settlements with the Department of Labor.
We can also perform a Wage and Hour Audit.
Workers' Compensation Representation
MSEC provides advice, counsel and training concerning workers compensation
issues. We will first review your case and make
proactive suggestions on how to manage the claim most effectively. MSEC also provides specialized assistance in sorting
out the interplay between workers' compensation and other employment
laws like FMLA and ADA. Our Workers' Compensation Services are designed
to help the employer develop and implement an effective strategy
to control workers' compensation claims.
Wrongful Discharge
We consult with members on how to avoid pitfalls, review handbooks
and policies to minimize legal risk, and assist in developing alternative
dispute resolution procedures.
