Employment Posters

On January 28, 2008, President Bush signed into law amendments to the Family & Medical Leave Act of 1993 that extend covered leave to families of military service members. This significant expansion of the FMLA will certainly prompt formal revision to the Department of Labor's model FMLA poster, WH Publication 1420.

On February 12, 2008, the Department of Labor posted a link to a "FMLA Poster Insert for Military Family Leave."

Although the "poster insert" does not modify WH Publication 1420, it appears the DOL has provided the poster insert as a temporary notice vehicle until formal revision of WH Publication 1420 takes place. Most likely, formal revision of the FMLA poster will follow DOL publication of final FMLA regulations on military family leave. In the interim, employers are strongly encouraged to print the poster insert and attach it to the current FMLA poster to demonstrate compliance. Until formal revision of WH Publication 1420 can be incorporated into the MSEC federal all-in-one employment law poster, shipments will be suspended. Colorado Minimum Wage Order Number 24 Poster Changes
Effective January 1, 2008, Minimum Wage Order Number 24 establishes a new state minimum wage rate of $7.02 per hour. The minimum wage for tipped employees increases to $4.00 per hour at the same time. On December 3, 2007, the Colorado Division of Labor published the Colorado Minimum Wage Order 24 Poster to replace the Number 23 poster. Although the text of the Wage Order itself has not changed beyond revisions to the minimum wage figures, effective date, and substitution of "24" for "23," the revised Number 24 Poster contains several changes.

The most significant revisions occur in the paragraph titled "Tipped Employee Minimum Wage" in the Number 24 Poster, formerly "Tip Credit" in the Number 23 Poster. That paragraph now identifies the $4.00 per hour minimum wage for tipped employees effective January 1, 2008, as well as the $3.83 per hour minimum wage for tipped employees effective January 1, 2007. The prior poster does not contain a minimum wage figure for tipped employees. Also, beyond a minor language change to begin the paragraph, the Division has added a sentence to close the paragraph: "No more than $3.02 per hour in tip income may be used to offset the minimum wage of tipped employees." This sentence clarifies that regardless of any tip credit calculation to assert that a worker is making at least $7.02 per hour overall, a tipped employee must be paid the $4.00 minimum wage as of the New Year and $3.83 per hour until then.

Also significant, the revised Number 24 Poster presents both the 2008 state minimum wage and 2007 minimum wage in increased size or font compared to the Number 23 poster, which did not include the prior minimum wage at all.

Less substantive changes to the Number 24 poster include:

  • Deletion of the Division's Colorado Springs address
  • Change from all capitol letters to lower case letters for covered industry designation language
  • Change to Number "24" and effective date of January 1, 2008
  • Deletion of "Workshift" defining sentence
  • Reordering of paragraphs - "Rest Periods" and "Meal Periods" now precede "Uniforms" and "Recovery of Wages"
  • "MUST BE POSTED IN AN AREA FREQUENTED BY EMPLOYEES WHERE IT MAY BE EASILY READ" now replaces "MUST BE POSTED IN CONSPICUOUS PLACE WHERE EMPLOYEES MAY READ"

Colorado Workers' Compensation Act Poster Changes
The Division of Workers' Compensation published a revised "Form WC49," in November 2007. This poster provides notice of certain entitlements regarding workers' compensation. Form WC50, published in 1999, has not been revised at this time. MSEC's Colorado all-in-one employment law poster contains the Form WC49 revisions.
